A company doing business in Texas must file an Assumed
Name Certificate (d.b.a. 'Doing Business As') with the county clerk of each county in which the business will be conducted.
Assumed Name Certificates are good for 10 years from the
date of filing or a shorter period of time may be indicated on the application.
Currently the only method to ensure a thorough search of
an Assumed Name is to personally appear in the County Clerk's Office to conduct the search.
Once your search is completed, the application must be
signed in front of a notary public. There are a few notaries at the courthouse. Then your application can be filed at
the clerk’s office.
Fee
The fee for an Assumed Name Certificate
to be filed and recorded is $15.00. Each additional signer after the first is
$.50 each.
Accepted payment options are: cash, money order, cashier's
check or business check.
The same fees apply for Abandonment of Assumed Name filings.
The withdrawal of a partner or abandonment of an assumed name is recorded in the same office.
NOTE: Filing an Assumed Name Certificate
does not prevent another party from using the same name. Direct any legal question regarding a business name to an attorney.
