Birth records are confidential for 75 years and death records for 25 years; therefore, issuance is restricted to qualified applicants. After the confidential periods, the records become public.
A qualified applicant is defined as the person whose name is on the certificate, immediate family member (either by blood or marriage), his or her guardian, or his or her legal representative:
- Parent
- Brother or sister (copy of their birth record to verify parent)
- Legal guardianship (with proof of court order papers)
- Grandparents (copy of son's or daughter's birth record to verify parent)
- Step-parents (can obtain a stepchild's birth certificate up to the age of 17 years old with proof of marriage license)
- Legal representative of a qualified applicant (provide a release which documents a direct and tangible interest in the record you are requesting)
